Article III, Section 3, Clause 1 of the U.S. Constitution states:
"Treason against the United States, shall consist only in levying War
against them, or in adhering to their Enemies, giving them Aid and
Comfort. No Person shall be convicted of Treason unless on the testimony
of two Witnesses to the same overt Act, or on Confession in open Court."
Article III, Section 3, Clause 2 states:
"The Congress shall have Power to declare the Punishment of Treason, but
no Attainder of Treason shall work Corruption of Blood, or Forfeiture
except during the Life of the Person attainted."
Treason Explained
The Constitution defines treason as levying war against the United
States or giving its enemies "aid and comfort." It also specifies that
the federal government cannot secure a conviction for treason unless two
witnesses testify to the same overt act or if the person accused of
treason confesses in open court.
Clause 2 makes clear that Congress has the power to declare the
punishment for treason.
